Service Provider Role & Client Responsibilities

1.CallBlade's role

For outsourced agent, contact center, and calling platform services, CallBlade acts as an independent service provider. CallBlade supplies trained personnel, technology, and operational management to execute calling and messaging campaigns designed and directed by its clients.

For these services, CallBlade:

  • does not sell, supply, rent, broker, or append consumer contact data or leads;
  • does not collect or generate the consumer consent on which a client's campaign relies;
  • does not determine which consumers a client chooses to contact; and
  • does operate every campaign under the CallBlade policies published in this Compliance Center, including our Do Not Call Policy, which no client may override.

2.The client is the seller and the data owner

Each client is the seller or the party on whose behalf calls are made, and the owner of the data it provides. Each client is solely responsible for:

  • the lawful sourcing of every phone number and consumer record provided to CallBlade, including data obtained from lead vendors, affiliates, publishers, or other third parties;
  • obtaining, documenting, and retaining consent that satisfies the TCPA and every applicable state law for the specific calls and messages requested;
  • the accuracy and legality of scripts, offers, claims, pricing, and product information provided to CallBlade;
  • the seller's own licensing, registration, bonding, and regulatory obligations;
  • maintaining its own internal Do Not Call list and honoring the Do Not Call requests CallBlade reports to it, across all of its own systems and other vendors; and
  • compliance with industry-specific rules governing its products, such as insurance, healthcare, Medicare, financial services, home improvement, and solar regulations.

3.Client certifications

Before any campaign launches, and for every data file uploaded, the client certifies that:

  • each number has the consent required for the type of call or message and technology requested;
  • consent was obtained for the client specifically, not generically or for unnamed "marketing partners";
  • the data has been scrubbed against the client's own internal Do Not Call list; and
  • the client will produce consent records within two (2) business days of request.

4.What CallBlade does regardless

Even though the client owns its data and consent, CallBlade independently:

  • scrubs campaign data against the National Do Not Call Registry, applicable state lists, and the CallBlade Master Suppression List before dialing;
  • enforces calling hours, frequency caps, disclosures, and abandonment limits;
  • honors every Do Not Call request with prejudice; and
  • refuses or suspends any campaign that appears to rely on unlawful data or deceptive practices.

5.Right to refuse, audit, and suspend

CallBlade may, at its sole discretion and without liability:

  • request consent records for any number, or a sample of numbers, at any time;
  • refuse data that appears to be purchased, aged, scraped, or obtained without seller-specific consent;
  • refuse any script or instruction that CallBlade believes is misleading or non-compliant; and
  • suspend or terminate any campaign immediately when a compliance concern arises, including a consumer complaint, a demand letter, a missing consent record, or an attempt to override a Do Not Call request.

6.Responsibility and indemnification

Because the client controls the data, the consent, and the content of its campaign, the client bears responsibility for claims arising from them. Under CallBlade's client agreements, clients indemnify, defend, and hold CallBlade harmless from claims, demands, fines, and costs arising from the client's data, consent, lead sources, scripts, products, or instructions, including claims under the TCPA, the Telemarketing Sales Rule, and state telemarketing laws. The client agreement controls the specific terms.

7.CallBlade-generated inbound calls

Where CallBlade itself generates consumer-initiated inbound calls through its own advertising (for example, pay-per-call traffic sold to buyers), CallBlade is responsible for the lawfulness of its own advertising and call-routing disclosures, and buyers remain responsible for their own conduct on and after those calls, including any follow-up outbound contact.
